Section 11
<br> who may request the release of witness examinations and closed questions
If it appears that a person residing abroad should be admitted as a witness in connection with a judicial proceeding, and if such a person is unwilling or unable to come to Nepal, the court may order that such person be admitted as a witness by the court of a foreign state.
(2) If the witness is ordered to be examined in accordance with sub-section (1) and such witness is unable to appear in the court of a foreign state, the court may order the witness to be examined through closed questions.
(3) Regardless of what is written in sub-section (2), the court may order the examination of witnesses and closed questions at the same time according to the request of the concerned party.
(4) If a witness is unable to appear in the court of a foreign country due to old age or physical infirmity, or if a witness is unable to appear in the court of Nepal due to staying abroad, and the court deems such a witness to be examined through audio-visual communication (video conference), hearing- He may order the examination of witnesses through visual communication.
(5) In case of order according to this section, the court shall send it in writing to the central authority.
